Town of Union Incentive Programs
The Economic Development Department provides financial assistance to start-up and expanding businesses through the Local Development Corporation of the Town of Union. The Town of Union Business Assistance (TUBA) Program, Central Business District (CBD) Program, Commercial Facade Program, Emerging Enterprise/Emerging Market Entrepreneurial (E³), Microenterprise Program, Section 108 Program and Site Preparation Program Funding are several of the loan programs offered through the Local Development Corporation of the Town of Union.
In addition to low cost financing programs, the Town of Union Economic Development Department can assist with other general business information. The Economic Development staff can provide information and referrals for commercial and industrial firms. Site selection and relocation assistance, access to county, state and federal programs, and assessment and tax information, are all available through the Town of Union Economic Development office.
The Town of Union Business Assistance (TUBA) Program is a powerful tool in promoting economic development in the entire Town of Union.

Interest Rate (as of 11/15/2012): 3%
The three percent interest rate is fixed for 5 years. Depending on the term of the loan, the interest rate may be adjusted after 5 years to reflect the interest rate used by the Local Development Corporation. The interest rate will have a cap of 3%.
Up to 40% of eligible projects, generally not to exceed $200,000. Minimum loan is $10,000.
Any legal borrowing entity. No borrower that has defaulted on a previous Local Development Corporation loan will be eligible to apply.

The Central Business District (CBD) Loan Program is a key component in promoting owner occupied commercial buildings in areas that have traditionally been recognized as our business districts in the Town of Union, Village of Endicott and Village of Johnson City.

The Commercial Façade Program is essential to the Economic Development Department’s overall mission to assist in the prevention and elimination of slums and blight and to encourage the revitalization and eliminate the deterioration of commercial and industrial centers within the Town’s urban core “Central Business Districts.”

Commercial property owners applying for façade funding to lease to a tenant engaged in one or more of the following industries sectors will not be eligible; Not-for-profit organizations, Recreation facilities not open to the public; Adult entertainment operations, Gambling facilities; Day care centers, if not licensed by the state, Residential housing, if it’s determined that the residential component of the project will be occupying more than 49% of the buildings overall usable square footage, in addition to other industry sectors that may not be listed above

Financial assistance may be available in the form of a Section 108 loan for eligible economic development projects. Maximum loan amount will be based on the town’s annual allotment under the Community Development Block Grant (CDBG) program funds. The term of the loan may be for as long as 20 years. The interest rate on the loan typically does not exceed the usual Treasury borrowing rate by more than a small additional basis point spread, depending on the maturity.
Proposals for funding consideration must meet the Federal Community Development Block Grant objective of "prevention and elimination of slums and blight."Evidence of blighted conditions may be provided through the following: Abandonment of buildings, as evidenced by lack of occupants; Removal of utilities; Boarded and/or physical condition of entries and windows ; Violations, as cited by appropriate municipality. An environmental audit of the property may be required as part of application procedures.
Up to 90% of eligible projects, generally not to exceed $100,000. Minimum loan is $10,000.

By networking with local brokers, economic development staff can also assist business contacts in identifying Town of Union sites.
The E³ Program is a key component in promoting the entrepreneurial spirit by encouraging research and development in emerging fields and/or improving upon existing technologies.

There will be a 0% percent interest rate for the first year of the loan and 1% for the start of year two to the end of year three. For the remaining term of the loan the interest rate will be 2%.
The Borrower may also request a deferment/moratorium of principal payments for the first six months of the loan.

Such knowledge must include knowledge of billing practices, competition, legal issues, marketing and advertising, etc. Start-up businesses may obtain assistance with their business plan and other issues through the Small Business Development Center at Binghamton University or similar private and public agencies.

The Microenterprise Program is an initiative in order to make funding available to start-up or existing businesses with five (5) or fewer employees (one of which must be the owner of the existing or proposed business) that may not be able to be approved for a loan through what might be considered a traditional means of financing (i.e. Commercial Bank, Credit Union, etc..) without the use of public funds.

The Economic Development Department provides financial assistance to businesses located in a flood impacted area through the Local Development Corporation (LDC) of the Town of Union. The Town of Union Flood Assistance Loan Program (F ALP) is one of several loan programs offered by the Local Development Corporation. The Town of Union LDC will work in conjunction with Federal, State and County Flood Assistance Programs, as well as private sector and national flood insurance programs, to maintain a business operation in a flood impacted area.

Application Period: Based on a Federal, State or Locally declared flood disaster.
Interest Rate: 0%.
Amount of Financing: Up to 3 months of an eligible business historical operating expenses.
Borrower: Any legal borrowing entity located in a flood impacted area. No borrower that has defaulted on a previous Local Development Corporation loan will be eligible to apply.
Eligible Areas: Declared flood disaster areas in the Town of Union, including the Villages of Endicott and Johnson City.
Eligible Use of Proceeds: Working Capital Loan.
Ineligible Use of Proceeds: As determined by Town LDC Board.

Amount of Participation: Subject to other sources of flood assistance that the applicant may be eligible for.
Term of the loan: Not to exceed 15 months (comprised of 3 months of deferred payments and 12 months of principal only payments).
Collateral: As determined by Town LDC Board.
Guarantees: Personal guarantees from company owners and spouses if involved in the operation of the business. Corporate guarantees.

Parts of the Village of Endicott and the Village of Johnson City are located in a "Historically Underutilized Business Zone" (HUBZone). The HUBZone Empowerment Contracting Program stimulates economic development and creates jobs in urban and rural communities by providing Federal contracting preferences to small businesses. These preferences go to small businesses that obtain HUBZone certification in part by employing staff who live in a HUBZone. The company must also maintain a "principal office" in one of the these specially designated areas. A principal office can be different from a company headquarters.
NYS En-Zone Boundaries - Downloadable GIS Files
Downloadable files of mapped boundaries for New York State Environmental Zones (En-Zones) have been developed by the NYS Department of Labor (as required by TAX § 21(b)(6)), and made available by the DEC's Division of Environmental Remediation.
These files can be used by NYS Brownfield Cleanup Program (BCP) applicants, environmental professionals and the public to identify and map designated En-Zones areas.
If at least 50 percent of the area of a BCP site is located in a designated En-Zone, it is eligible for additional BCP tax credits. In order to be designated as an En-Zone, the census tract must have a poverty rate of 20 percent and unemployment rate at least 1.25 times the statewide unemployment rate. A site can also qualify if it has a poverty rate at least double the rate for the county in which the tract is located.
En-Zone Boundary Files in Google Earth
The data set of EnZone boundaries can be viewed in Google Earth. To use Google Earth, users must first download the software from Google (see link in right column under Links Leaving DEC's Website). Then, simply click on enzone2013.kmz (KMZ) (5 MB) to open or save. Type A En-Zones are shown in green, Type B are shown in blue, and Type AB are shown in pink.
En-Zone Boundary Files for ESRI ArcGIS
The data set of EnZone boundaries is also provided in shapefile, or ".SHP" format. This file must be opened and used with ESRI ArcGIS (see the "Links Leaving DEC" on the right for information on downloading a free ESRI ArcGIS mapping program.)
To open the file, save enzone.zip (ZIP) (7 MB) to a directory on your computer's hard drive. This contains several files that will work together within the ESRI ArcGIS program to display the data. Unzip/extract enzone.zip and add the shapefile to your ArcGIS project.
Information About The En-Zone Boundaries Data Set
Summary
The NYS Department of Labor's State Data Center designates Environmental Zones ("En-Zones") in which BCP tax credits are enhanced. The most recent five-year American Community Survey (in this case the 2009-2013 American Community Survey 5-Year
Estimates) is used to designate tracts that meet the En-Zone requirements of either census tracts with a poverty rate of at least 20 percent and an unemployment rate of at least 125 percent of the New York State unemployment rate, or a poverty rate of at least double the rate for the county in which the tract is located.
New York State is participating in the new Opportunity Zone community development program, offered through the Tax Cuts and Job Acts of 2017. The federal program encourages private investment in low-income urban and rural communities. New York State is currently reviewing eligible census tracts to nominate as Opportunity Zones and encourages public engagement during this process. The final recommendation will be based on analyses by Empire State Development (ESD), New York State Homes and Community Renewal (HCR) and the state’s Regional Economic Development Councils (REDCs).
This federal program will establish Opportunity Zones, or low-income census tracts, to boost private investment in under-served urban and rural communities. These census tracts may receive funding from Opportunity Funds, which allow a wide array of investors to pool their resources to rebuild distressed neighborhoods. Commercial and Industrial properties may be entitled to a “phased-in” tax increase for new construction and/or substantial renovation of real property if located within the geographic boundaries of the Town of Union Business Investment Exemption Zone
50% of increased tax assessment due to the construction would be exempt in the 1st year after completion, and that amount would decrease 5% each year from the 2nd through 10th years
Verified expenditures of $50,000 must be made for new construction
Site must be 1 or more acres
Project must generate additional tax revenue for taxing authorities
An RP-485-b Real Property Tax Exemption Application must be filed with the Town of Union Tax Assessor between January 1st and March 1st
